CA 92324 <br />RE: Our Claim: <br />Claimaat: <br />Date of Loss: <br />Dear Ms. Monterrosa: <br />City of Coitoa <br />Ana Monterrom <br />August 31, 1998 <br />Our investigation into the circumstances surrounding the claim you recently presented to the Cit} <br />has been completed. <br />The City reports that on August 31, 1998, the Electric Utility experienced a power outage that did <br />affect your location. T"ne outage occurred at 5:35 p.m., and lasted 2. 1/2 hours. and was caused by <br />a severe lightening storm with very high winds. <br />This type of occurrence can be found described in Customer Service Policy No. 8 "Intm7aptions <br />or Defects in Service: <br />b. Uncontrollable forces which states. The City shall not be liable on account of <br />interruptions to service or by reason of any claim for loss or damage resulting therefrom <br />caused by uncontrollable forces, the term 'uncontrollable forces" being deemed for the <br />Purposes of these customer service policies to mean flood, earthquake, storm, lightening, <br />fire, epidemic, failure of facilities, war, riot, eiviI disturbances, labor disturbances, <br />restraint by Court or public authority, or any like cause beyond the control of the City. <br />The City shall exercise due diligence in restoring service in the event interruptions occur, <br />therefore, by copy of this correspordence to the Cit}, it will be our recommendation that <br />this claim be rejected in its entirety. <br />WARD NORTH AMERICA.
