request for reimbursement of legal expenses which he has incurred or will incur with respect to
<br />the FPPC Investigation, as recited in this Agreement.
<br />3.3 This Agreement has been duly accepted and consented to by the
<br />Agreeing Parties hereto. The representatives signing this Agreement on behalf of the City, the
<br />Agency and Beltran expressly represent that they do so with the full authority and consent of said
<br />Parties.
<br />4. RELEASE:
<br />4.1 Upon the occurrence of the events and conditions set forth in
<br />Sections 3.1 through 3.3 inclusive, Beltran, on his own behalf and on behalf of his agents,
<br />assignees, transferees, representatives, partnerships, corporations or any other entity of which he
<br />is a principal or which he controls, and successors in interest of each of them, fully and generally
<br />releases and forever discharges the City and the Agency and their -agents, representatives,
<br />predecessors, successors, assigns, insurers, attorneys, employees, officers, trustees, directors,
<br />agents and all persons acting by, through and/or in concert with any of them, from and against any
<br />and all claims, any and all known and unknown obligations, liabilities, demands, damages,
<br />expenses, costs, attorneys' fees, and causes of action related to or arising out of Beltran's request
<br />for reimbursement of legal expenses or for the provision of a defense, which he has incurred or
<br />will incur with respect to the Actions, including without limitation, all claims of racial
<br />discrimination, except for those claims expressly reserved herein pursuant to Section 4.4 below,
<br />r and/or failure to act on Beltran's request (all of which released matters shall hereinafter be
<br />referred to as the "Released Acts").
<br />4.2 Upon the occurrence of the events and conditions set forth in
<br />Sections 3.1 through 3.3 inclusive, and with the exception of those, claims expressly reserved in
<br />this Agreement, the City and the Agency, on their own behalf and on behalf of their agents,
<br />assignees, transferees, representatives, insurers and successors in interest, fully and generally
<br />release and forever discharge Beltran and his agents, representatives, predecessors, successors,
<br />assigns, insurers, attorneys, employees, officers, trustees, directors, agents and all persons acting `
<br />by, through and/or in concert with any of them, from and against any and all claims, and any and
<br />all known and unknown obligation, liabilities, demands, damages, expenses, costs, attorneys' fees,
<br />and causes of action related to or arising out of the Released Acts.
<br />4.3 Except for those claims expressly reserved in this Agreement, the
<br />release set forth herein by the parties is a full and complete general release of the claims for
<br />damages, debts, liabilities, demands, obligations, costs, expenses, compensation, actions, and
<br />causes > of action, relating to or arising out of the Released Acts, and is intended to encompass all
<br />known and unknown, foreseen and unforeseen, claims which each Party may have against the
<br />other or any of the related Parties, relating to or arising out of the Released Acts. Accordingly,
<br />with respect to the Released Acts, each Party does hereby expressly waive and relinquish any and
<br />all rights and benefits which each may otherwise have pursuant to Section 1542 of the California
<br />Civil Code which provides that:
