RESOLUTION NO. R -lo -99 <br />RESOLUTION OF CONSIDERATION TO ALTER RATE AND <br />METHOD OF APPORTIONMENT OF SPECIAL TAXES <br />CITY OF COLTONCOMMUNITY FACILITIES DISTRICT NO. 90-1 <br />(MOUNT VERNON CORRIDOR) <br />Notice is; hereby given that on January 19, 1999, the City Council (the "Council") of the <br />City of Colton (the "City") adopted its Resolution of Consideration To Alter Rate and Method <br />of Apportionment of Special Taxes (the "Resolution of Consideration7) with respect to its <br />Community Facilities District No. 90-1 (Mount Vernon Corridor) (the "CFD") under the Mello - <br />Roos Community Facilities Act of 1982, as amended (the "Act"). Under the Act and the <br />Resolution of Consideration, the Council gives notice as follows: <br />1. The text of the Resolution of Consideration, with the Exhibit A thereto, as <br />adopted by the Council, is on file with City Clerk and reference is made thereto for the <br />particular provisions thereof. The text of the Resolution of Consideration is summarized as <br />follows: <br />a. As permitted by the Act, the Council has undertaken proceedings and <br />has established the CFD, which is known as "City of Colton, Community Facilities <br />District No. 90-1 (Mount Vernon Corridor)," the boundaries of which are shown on the <br />map thereof filed in Book 161 of Maps of Assessment and Community Facilities <br />Districts at Pages 21 and 22, in the office of the County Recorder, County of San <br />Bernardino, State of California. <br />b. The Council has proposed to consider the alteration of the Rate and <br />Method of Apportionment of Special Tax (the "Rate and Method") among the parcels of <br />real property within the CFD, to read as more fully described in the Resolution of <br />Consideration and Exhibit A thereto. <br />C. The Council has determined that such proposed alteration will not <br />interferewith the timely retirement of any debt incurred with respect to the CFD. <br />d. As set forth below, the Council will hold a public hearing on said <br />alteration. of the Rate and Method. <br />2. The time and place established under the Resolution of Consideration for the <br />public hearing required under the Act are Tuesday, March 2, 1999 at the hour of 6:00 p.m. or as <br />soon as possible thereafter, in the City Council Chambers, 650 N. La Cadena Drive, Colton, <br />California 92324. <br />3. At the hearing, the testimony of all interested persons or taxpayers for or against <br />the proposed alteration of the Rate and Method will be heard. Any person interested may file a <br />protest in writing as provided in Section 53336 of the Act. If fifty percent or more of the <br />registered voters�, or six registered voters, whichever is more, residing within the CFD, or the <br />
