Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds the Zone Change complies with "CEQA" <br />and hereby adopts the negative declaration for the following reasons: <br />A. The negative declaration and initial study prepared for the Application <br />contain a complete and accurate reporting of the environmental impacts associated with the <br />Application. The documents have been completed in compliance with CEQA and the State <br />CEQA Guidelines. <br />B. The negative declaration and initial study prepared for the Application <br />reflect the independent judgment of the City Council, <br />C. As the decision making body for the Application, the City Council <br />reviewed and considered the information contained in the negative declaration, initial study and <br />administrative record prior to approving the Application. <br />D. All environmental impacts of the Application are insignificant. There is <br />no substantial evidence in the record supporting a fair argument that the Application will result <br />in significant impacts. <br />E. The Application will not result in any changes to the following <br />resources: (1) riparian land, rivers, streams, watercourses and wetlands; (2) native and non- <br />native plant life and the soil required to sustain habitat for fish and wildlife; (3) rare and unique <br />plant life and ecological communities dependent on plant life; (4) listed threatened and <br />endangered plants and animals and the habitat in which they are believed to reside; (5) all <br />species listed as protected or identified for special management in the Fish and Game Code, the <br />Public Resources Code, the Water Code or regulations adopted thereunder; (6) all marine and <br />terrestrial species subject to the jurisdiction of the Department of Fish and Game and the <br />RIVPLTB\MXM\511005 4 <br />
