Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the Zone Change complies with "CEQA" and hereby adopts the negative declaration for the following reasons: A. The negative declaration and initial study prepared for the Application contain a complete and accurate reporting of the environmental impacts associated with the Application. The documents have been completed in compliance with CEQA and the State CEQA Guidelines. B. The negative declaration and initial study prepared for the Application reflect the independent judgment of the City Council, C. As the decision making body for the Application, the City Council reviewed and considered the information contained in the negative declaration, initial study and administrative record prior to approving the Application. D. All environmental impacts of the Application are insignificant. There is no substantial evidence in the record supporting a fair argument that the Application will result in significant impacts. E. The Application will not result in any changes to the following resources: (1) riparian land, rivers, streams, watercourses and wetlands; (2) native and non- native plant life and the soil required to sustain habitat for fish and wildlife; (3) rare and unique plant life and ecological communities dependent on plant life; (4) listed threatened and endangered plants and animals and the habitat in which they are believed to reside; (5) all species listed as protected or identified for special management in the Fish and Game Code, the Public Resources Code, the Water Code or regulations adopted thereunder; (6) all marine and terrestrial species subject to the jurisdiction of the Department of Fish and Game and the RIVPLTB\MXM\511005 4
