B <br />Colton, CA 92324 <br />RE: Claimant Lisa Winter <br />Date of Loss November 29, 1998 <br />Dear Ms. Hernandez: <br />Ward North America is the liability claims administrator for the City of Colton. We recently <br />received a copy of the claim you filed on behalf of your daughter, Lisa Winter, for an incident that <br />occurred on November 29, 1998. <br />According to the Colton Police Department, a call was received at the police department of shots <br />being fired in the area of Fogg and Lincoln on November 29, 1998 at approximately 2:30 a.m. <br />Upon arrival of units in the area, there were 15 shell casings from an AK -47 type assault rifle <br />located on the roadway on Lincoln near the intersection of Fogg. Further investigation led to a <br />gathering at 260 West Fogg Street. Further investigation found a 30 -round magazine belonging to <br />an AK -47 rifle. <br />While inside the residence looking for the rifle, Colton police officers came into contact with <br />numerous people, some of which were intoxicated. Among these people was 16 -year old Lisa <br />Winter. During the contact, the officers were attempting to maintain the sight of each other for <br />their safety among the intoxicated crowd and also maintain some type of search and observations <br />for the assault rifle they believed was still in the residence.While in the residence, Office Drey was <br />attempting to handcuff Lisa Winter. Officers observed her kicking and swinging her arms wildly <br />trying to get away from the officer. Lisa Winter was handcuffed and placed on the kitchen floor. <br />While Winter was on the kitchen floor, another combative female was taken into custody. During <br />this time, Lisa Winter began to kick Officer Ferguson, at which time Lisa Winter was struck by one <br />of the officers in an attempt to get her to cease her assault on the officer. <br />The AK47 rifle was subsequently located and arrested as a result of the incident was 18 -year old <br />Marlona Rojas and Lisa Winter. <br />Based on the investigation, it will be our recommendation to the City of ColIap3 i e <br />claim be rejected in its entirety. p 15 Vim" K �r e n <br />IIU!1 <br />JUN 2 2 1999 <br />WARD NORTH AMERICA, INC.
