police response calls related to the following incidents: grand theft auto, narcotics and DUI <br />violations, assault and battery, disturbances (fighting), vehicle burglaries, public drunkenness, <br />attempted rape and shots fired. Moreover, the Riverside Police Department recalled one incident <br />at the Rocks Club in Riverside where one of the owners was shot at while in the parking lot of the <br />business. (See attached Exhibit B.) <br />This hearing has been scheduled to review compliance with the conditions of approval of the <br />dance permit. Specifically, the City Council should determine whether recent police incidents at <br />the Club and other possible violations of the dance permit conditions of approval warrant <br />revocation of the dance permit. Colton Municipal Code Section 5.32.050 establishes the <br />standards for revocation of a dance permit. Section 5.32.050 provides: <br />"Whenever the presiding officer and members of the city council shall issue ... any <br />permit under the terms of this section ... the same may be revoked at anytime <br />thereafter, by the city council, if they become satisfied that the conduct of such <br />public dance hall ... does not, or will not, comport with public welfare for any <br />reason, or in the case of a public dance hall that the same has been conducted in an <br />illegal. improper or disorder] manner... The city council may make rules governing <br />public dance halls..., and may revoke or suspend permits issued ... where the <br />proprietor or person in charge thereof violates or permits any infraction of any <br />such rules or any law of the state or any ordinance of the city." (Emphasis added.) <br />(See Exhibit C.) <br />Further, the City Council must determine, by a preponderance of the evidence, that the conduct of <br />the Club does not, or will not comport with the public welfare, or the Club has been conducted in <br />an illegal, improper or disorderly manner. <br />The Police Department and City staff have documented the following instances where the Club's <br />operations have failed to comport with the public welfare or have been conducted in an illegal, <br />improper or disorderly manner: <br />Colton Police Officers have responded to at least three significant incidents since <br />the dance permit was issued on April 6, 1999 (See Exhibit D.). These include the <br />following: <br />a. April 25, 1999. The manager of the Club reported approximately 30 <br />people fighting in the parking lot. <br />b. May 11, 1999. A customer reported his vehicle had been vandalized. <br />C. May 13, 1999. After an altercation inside the Club, a customer shot the <br />manager of the Club while leaving the premises in his vehicle. The <br />customer was apprehended shortly thereafter by the Colton Police <br />Department. Attempted murder charges are pending. <br />RVPMNMXr&512779 <br />
