I I ORDINANCE NO. <br />2 AN ORDINANCE OF THE CITY OF COLTON, CALIFORNIA ADDING CHAPTER <br />3 5.38 TO THE COLTON MUNICIPAL CODE IN ORDER TO ENACT REGULATIONS <br />4 AND ADOPT A FEE SCHEDULE FOR MOTION PICTURE PRODUCTION <br />5 ACTIVITIES <br />6 WHEREAS, the City Council of the City of Colton ("City') finds and determines that the making of motion <br />7 pictures could be beneficial to the economic well being of the State of California, City and the needs of society; <br />8 and <br />9 WHEREAS, the City desires to support the motion picture industry by actively participating in and with the film <br />10 commission in their effort to locate filming within the Inland Empire, more specifically Colton; and <br />T1 WHEREAS, under the City's police powers pursuant to the California Constitution Article XI, Section 7 the City <br />12 is authorized to establish a Film Permit the city limits of Colton; <br />13 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES HEREBY ORDAIN AS <br />14 FOLLOWS: <br />15 Section 1. Chapter 5.38 is hereby added to the Colton Municipal Code to read as follows: <br />16 Chapter 5.38 <br />17 FILM PERMIT <br />18 SECTIONS: <br />19 5.38.010 Definitions. <br />20 5.36.020 Requirements. <br />21 5.38.030 Application --Filing and Fees. <br />22 5.38.040 Payment --Special City Services. <br />23 5.38.050 Permit --Rules and Regulations. <br />24 5.38.060 Permit—Modifications. <br />25 5.38.070 Permit --Exemptions. <br />26 5.38.080 Liability Provisions. <br />27 5.38.090 Permit --Failure to Obtain or Abide by its Terms <br />28 5.38.100 Constitutionality. <br />29 5.38.010 Definitions. <br />30 I For the purposes of this Chapter, the following words or phrases shall have the meanings as set out <br />31 1 herein. <br />32 A. "Charitable Films" shall mean Motion Pictures produced by a nonprofit organization, which <br />33 qualifies under Section 501(c)(3) of the Internal Revenue Code as a charitable organization. No person, directly <br />34 indirectly, shall receive a profit from the marketing and production of the film or from showing the film, tapes or <br />35 photos. <br />36 B. "Chief of Police" shall mean Chief of Police or his designee. <br />37 C. "City" shall mean any department or staff. <br />38 D. "City Manager" shall mean City Manager or his designee. <br />39 E. "Film Permit" is that permit required IA be obtained from the city prior to engaging in staging or <br />40 shooting Motion Pictures within the city boundaries. <br />Item # 4 <br />
