City of Colton <br />Agenda Report <br />Council Meeting of March 16, 1999 <br />Page 2 <br />❑ Each cart shall be required to have a sign permanently affixed to it identifying the <br />owner and the procedure required for authorized removal of the cart from the <br />parking facility. Additionally, the sign must state that the unauthorized removal of <br />carts from parking facilities or the unauthorized possession is a violation of the law. <br />A valid telephone number and/or address for returning carts removed from the <br />parking facility to the owner of the cart must be stated on the sign. <br />❑ All businesses furnishing carts shall post a sign stating that the removal of carts <br />without the written consent of the owner is prohibited by law. <br />❑ The City must provide the owner of the abandoned cart written notice of the cart's <br />discovery and location. Removal of the cart by the City may only occur three (3) <br />business days after such written notice is provided. Carts will be released to their <br />lawful owner if claimedwithin thirty (30) days after such removal and upon payment <br />of reasonable redemption fees. <br />❑ Carts shall be stored for a minimum of thirty (30) days after notice is given to the <br />owner of the cart after which unclaimed carts shall be disposed of at public auction <br />or otherwise disposed of. <br />❑ Carts will be designated as unidentified if the owner is unknown and not clearly <br />identified on the cart. <br />The period between the passing of the first reading of this Ordinance (supposing it <br />passes) and the time when the Ordinance becomes effective (approximately 51 days) <br />will be used to notify local store managers where shopping carts and/or laundry carts <br />are provided. Additionally, residents in areas where abandoned carts are routinely <br />found in abundance will also be notified. Such notification will be provided in the usual <br />fashion, by direct contact and via the telephone, by flyers to be delivered by the citizen <br />volunteers and by the multifamily housing task force. <br />FISCAL IMPACT: <br />There will be costs associated with the notification, collection, and storage components <br />of this program. These costs should be partially offset by the redemption and storage <br />fee to be assessed when owners claim their carts from storage. <br />RECOMMENDATION: <br />Staff recommends that the City Council waive the full reading and pass the first reading <br />of an Ordinance adding Chapter 6.18 to the Colton Municipal Code Regulating <br />Shopping Carts and Laundry Carts. <br />Aftachment <br />
