Waive Full Reading and Pass First Reading of an <br />Ordinance Adding Chapter 6.18 to the Colton Municipal Code <br />Regulating Shopping Carts and Laundry Carts, <br />ORDINANCE NO. 0-D6'~97(ff) <br />DATE: April 23,1999 <br />BACKGROUND: <br />Recently the City Council directed staff to bring forward an ordinance for consideration <br />to combat the accumulation and storage of abandoned shopping and laundry carts <br />throughout the City of Colton. On March 16, 1999 the proposed ordinance brought <br />before the City Council was pulled from the agenda to be reviewed by a committee and <br />discussed with businesses that would be effected if such an ordinace were adopted. <br />The "committee consisting of Council Members Bennett, Chastain and Cook and <br />Police Chief Pat Crowe and Assistant City Manager Daryl Parrish first met on March 29, <br />1999. The proposed ordinance was discussed and notification was prepared to inform <br />those businesses potentially effected of a committee meeting that was scheduled for <br />April 8, 1999. The attached notification was sent with a copy of the proposed ordinance <br />to the names on the attached list. <br />Present at the April 8, 1999 committee meeting were District Managers Steve Landry <br />and Bill Kemper from Stater Brothers Markets and Store Manager Jeff Hochaday from <br />Wal-Mart. Additionally, staff discussed the proposed ordinance by telephone with a <br />representative of the California Grocer's Association. The representatives of Stater <br />Brothers, Wal-Mart and the California Grocer's Association were all supportive of the <br />proposed ordinance. <br />Attached is the document drafted by the City Attorney and staff that creates the <br />authority for us to effectively mitigate the blight created throughout the community when <br />shopping carts and laundry carts are removed form their proper places and abandoned. <br />DISCUSSION/ANALYSIS- <br />The ordinance under consideration declares that the unauthorized use, accumulation <br />and storage of abandoned shopping carts and laundry carts on any parcel of land <br />within the City constitutes a public nuisance. The ordinance will create a vehicle for <br />City staff to collect and store abandoned shopping carts and laundry carts from public <br />and private property (with the consent of the owner, or by warrant) providing that proper <br />notification is given. The ordinance also provides the opportunity for the city to assess <br />a redemption and storage fee to cover all costs of removal, storage and related <br />Item # I <br />
