Garcia, City Manager <br />Tom Hendrix, Fire Chief <br />First Reading of an Ordinance Relating to the Sale and Use of Safe and Sane <br />Fireworks for the Millennium Celebration <br />April 21, 1999 <br />On January 1, 1999, AB 2090 became effective in California. This bill, drafted by Congressman Gary <br />Miller, gives local government the option of allowing the sale and use of "Safe and Sane" fireworks for <br />the Millennium Celebration. The provisions of the bill allow, if authorized by a city Ordinance or <br />Resolution, the sale of certified safe and sane fireworks from 9:00 am on December 26, 1999 through <br />January 1, 2000. <br />DISCUSSION/ANALYSIS: <br />The sale of safe and sane fireworks is currently regulated by the City's Municipal Code, Chapter 6.32, <br />which authorizes the issuance of 14 licenses each calendar year for the Fourth of July celebration. <br />Allocation of these licenses is designated by Resolution No. R-40-96, which provides the list of <br />approved organizations. Adoption of this Ordinance will allow for the sale of safe and sane fireworks <br />in accordance with the City's existing requirements for the specified time period. <br />In addition, the provisions of this Ordinance will become inoperative on January 2, 2000. <br />ALTERNATIVES <br />Not to allow the sale or use of certified safe and sane fireworks during the Millennium Celebration. <br />FINANCIAL IMPACT: <br />None <br />ENVIRONMENTAL IMPACT: <br />None <br />RECOMMENDATION: <br />Staff recommends that the City Council approve and waive the first reading of the attached Ordinance <br />as it pertains to the sale and use of certified safe and sane fireworks for the Millennium Celebration. <br />Report Prepared By: Alan J.
