WARD <br />STRATEGIC CLAIMS SOLUTIONS <br />March 26, 1999 <br />Peter Chang <br />1594 Cindee Lane <br />Colton, CA 92324 <br />Re: Our Client <br />Claimant <br />Date of Loss <br />Dear Mr. Chang, <br />City of Colton <br />Peter Chang <br />11/24/98 <br />Io�t�E ��I1n <br />�, MAR 3 J 1939 <br />CITY OF COLTON <br />PERSONNEL <br />Our investigation into the circumstances surrounding your claim that you recently presented to <br />the City has been completed. <br />The City of Colton records indicate that on April 19, 1978, the City adopted Resolution 3805, <br />Customer <br />Service Policy, Water Rules and Regulations. Water Rule 911 Service Connections, Meters, and <br />Related Apparatus, states, "The customer shall, at his own expense and risk, furnish, install and <br />maintain all apparatus and appliances which are required to receive, control, regulate and utilize <br />the pressure and flow of water as furnished by the Department. The Department shall not be <br />liable for any loss or damaged caused by the improper installation, maintenance or malfunction <br />of such apparatus. The Department shall not be responsible for damage or inconvenience <br />occasioned by the misuse of water after it has left the meter, nor for any damage caused by the <br />turning on and off of water service by the Department forces." <br />Based on the above, by copy of this correspondence to the City it is our recommendation that <br />this claim be rejected in its entirely. <br />If you have any questions concerning this matter, please feel free to contact the undersigned. <br />Sincerely, <br />Ward -North America, Inc <br />J epi ca <br />for Adjuster <br />Cc: <br />Joanne Knowles <br />WARD.
