EXHIBIT "A" <br />The Planning Commission passed a motion to jointly deny 1) the zone change of <br />subject property from single family residential (R-1) to residential planned community (R1 - <br />PC), and 2) Tentative Tract 16019 for 52 single family homes on lot areas averaging 4,700 <br />SF (Files DT -28-99 and DZ -09-99, respectfully). 4 Planning Commissioners all expressed <br />the same reason for denying the joint applications -- that this Planning Commission will not <br />approve any single family residential lots in the City that did not meet the City minimum <br />standard area of 7,200 SF per lot. <br />I am appealing the Planning Commission LQinl Denial of DT -28-99 (Tract 16019) and <br />DZ -09-99 (zone change to R1 -PC) based on the following reasons: <br />1) The City does not have a 7,200 SF minimum standard for single family <br />residential lot areas. A range of minimum lot areas exist for each of 3 <br />separate residential single family zones as follows: <br />Zone Zone Name Minimum Lot Area <br />RE Residential Estates 20,000 SF <br />RI Single Family Residential 7,200 <br />R1 -PC Residential -Planned Community Variable <br />The Residential Planned Community Zone (RI -PC) allows a variable lot area <br />below 7,200 SF and, therefore, 7,200 SF is not the City minimum standard <br />area for a single family lot. <br />2) The Planning Commission denial of the zone change to RI -PC is a <br />recommendation only. All zone change actions are decided by the City <br />Council. <br />3) City Council approval of the zone change to Residential Planned Community <br />(R1 -PC) (DZ -09-99) invalidates the reason provided by the Planning <br />Commission for denial of Tract 16019 (DT -28-99). <br />4) Tract 16019 lot size area average of 4,700 SF is consistent with the R1 -PC <br />zone. <br />5) Tract 16019 does not have a negative impact on the 3 homes on Agate located <br />to the west or on the 10 homes on Cameo located to the south of the tract <br />compared to lot and home locations allowable under the current R-1 zoning. <br />6) Tract 16019 will benefit the immediate community because it will bring new, <br />larger, and more expensive homes and home buyers earning more than the <br />community average income to the community. This will have a positive <br />impact on the community. <br />7) Tract 16019 will benefit the City because it brings a high quality $7 Million <br />dollar project to the City in an area which has had virtually no new projects in <br />the past 15 years. <br />
