Each party to this Agreement hereby holds the other harmless <br />from all claims or lawsuits for damages to property and for <br />injuries to persons in or about said premises, arising from <br />its use of the premises or from the negligency of itself <br />or of its employees, agents, contractors or assigns. This <br />obligation will include providing a defense of lawsuits and <br />all related services. <br />10. This Agreement shall be subject to revision and modification <br />periodically upon the request and mutual agreement of the Board <br />of Education of the Colton Joint Unified School District and the <br />City of Colton. <br />114_ The CITY shall be responsible for the scheduling of the Lower <br />Field after normal school hours of operation. A schedule of <br />�• �vvR3 dates for such use will be so arranged as to avoid any conflict <br />e �\ between School and the Recreation Department use; that in the <br />scheduling of said open space, school events and recreation <br />programs shall have the first priority; and the recreation <br />program established by the Recreation Department shall have <br />second priority; and any other events by other groups or agencies <br />shall have third priority. CITY shall keep DISTRICT and school <br />principal aware of scheduled facility use. <br />12. Termination of Agreement. This agreement may be terminated by <br />either the DISTRICT or the CITY at end of any school year. <br />The termination will be made by the Board of Eduation or the <br />City Council adopting a motion or Resolution determining to <br />withdraw from the Joint Powers Agreement, and give notice of such <br />termination in writing, including a copy of the motion or <br />Resolution, at least sixty (60) days prior to the end of the <br />school year. Such notice of termination, together with a copy <br />of the required motion or Resolution, shall be given by the <br />Board of Educaiton to the City Manager of the City of Colton or <br />by the City Council to the Superintendent of Schools of the DISTRI <br />
