** 10'3BHd ICi01 ** <br />V <br />WARD <br />STRATEGIC CLAIMS SOLUTIONS Post -N' Fax Nate <br />March 8, 2000 <br />Joo Hee Park <br />873 North Rancho Avenue <br />Colton, CA 92324 <br />RE: Our Client: City of Colton <br />Claimant: Joe Bee Park <br />Date of Lou: December 11, 1999 <br />Dcar Mr. Park: <br />7e71 <br />Our investigation into the circumstances surrounding the claim you recently presented to the City has <br />been completed. <br />Y <br />The City of Colton has a customer service policy for the utility departments, which is Resolution #3734. <br />Policy 913, Sections A and B states: <br />The City will endeavor at all times to provide a regular and uninterrupted supply of <br />service but does not guarantee the same. The City, whenever it shall find it necessary <br />for the purpose of making repairs or improvements to its system, will have the right to <br />temporarily suspend the delivery of electric energy. The making of such repairs or <br />improvemcnts will be prosecuted as rapidly as may be practicable and, if practicable, at <br />such times as will cause the least inconvenience to the customers. The City will <br />endeavor to give the customer as much advance notice of such periods of suspension as <br />possible. <br />The City shall not be liable on account of interruptions to service or by reason of any <br />claire for loss or damage resulting therefrom caused by uncontrollable forces, the term <br />"uncontrollable forces" being deemed for the purposes of these customer service policies <br />to mean flood, earthquake, storm, lightning, fire, epidemic, failure of facilities, war, riot <br />civil disturbances, labor disturbances, restraint by court or public authority, or any like <br />cause beyond the control of the City.
