2. The applicant shall not enlarge, increase or extend any <br />nonconforming residential structure in such a way that it occupies any part of the <br />nonconforming residential structure that was not occupied on the effective date that it <br />became nonconforming. <br />Section 3. CEQA Determination. <br />The City Council hereby finds and determines that it can be seen with certainty <br />that there is no possibility that this ordinance may have a significant adverse effect on the <br />environment. Thus, the adoption of this ordinance is exempt from the requirements of <br />the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the <br />CEQA Guidelines. Staff is directed to file a Notice of Exemption with the San <br />Bernardino County Clerk's Office within five (5) working days of project approval. <br />Section 4. Certification; Effective Date. The City Clerk shall certify <br />to the passage of this Ordinance and cause the same or a summary thereof to be published <br />within fifteen (15) days after adoption in a newspaper of general circulation, printed and <br />published in Colton, California, and the Ordinance shall take effect thirty (30) days after <br />its enactment in accordance with the provisions of California law. <br />PASSED, APPROVED AND ADOPTED this day of 12001. <br />Deirdre H.
