r <br />Item #4 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF October 16, 2001 <br />TO: Honorable Mayor and City Council <br />FROM: City Attorney <br />SUBJECT: Discussion and Possible Action Regarding Filling of Mayor Pro <br />Tempore Vacancy <br />DATE: October 16, 2001 <br />BACKGROUND: <br />City staff requested that the City Attorney research the procedure for filling the Mayor <br />Pro Tempore vacancy and report back to the City Council. <br />DISCUSSION/ANALYSIS: <br />According to Section 36801 of the Government Code, the City Council must select one <br />of its members as mayor pro tempore. The procedure for the selection of mayor pro <br />tempore is found in Section 2.04.020 of the Colton Municipal Code, which provides: <br />"The city council shall select a member of the city council to <br />serve as mayor pro tempore by a majority vote of the full city <br />council at a regular open meeting. Candidates shall be <br />nominated solely by city councilmembers, and the city clerk <br />shall record the nominations. All nominations for mayor pro <br />tempore having been made and recorded, the city council <br />shall vote. Immediately following the selection, the city clerk <br />shall administer the oath of office and the mayor pro <br />tempore shall be installed. The mayor pro tempore shall <br />serve for a term of two years or until the expiration of his or <br />her term of city council office, whichever occurs sooner." <br />Accordingly, any member of the City Council may nominate a member as mayor pro <br />tempore. The member that is selected by a majority vote of the full City Council will be <br />appointed as mayor pro tempore. Although there are currently five members sitting on <br />the City Council, the full City Council is comprised of seven members. As such, four <br />members of the City Council, which constitutes a majority of the full City Council, must <br />approve the member who is nominated as mayor pro tempore. <br />
