CITY OF COLTON Item #11 <br />AGENDA REPORT <br />FOR THE COUNCIL MEETING OF October 16.2001 <br />TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL <br />4 <br />FROM: Ronald C. Kenny, Director of Parks, Recreation and Family Services et <br />SUBJECT: Approval of Joint Use Agreement between the City of Colton and the Colton <br />Unified School District for Colton Middle School <br />DATE: October 4, 2001 <br />The City of Colton and the Colton Unified School District have always enjoyed a supportive relationship. <br />Joint Use Agreements between the two agencies have been developed over the years for joint use of City <br />and School District facilities. These Agreements have been developed on a facility by facility basis. <br />ANALYSIS/DISCUSSION: <br />The City, School District and Colton Youth Soccer Organization are partnering in an effort to obtain a <br />State of California grant for sport lighting at Colton Middle School. The school has been the home of the <br />soccer organization for 24 years. During that time the group has not had the benefit of lights for weekday <br />practice sessions. They have requested that the City apply for one of many grants available under the <br />Safe neighborhood Parks, Clean Water, Clean Air and Coastal Protection Bond Act of 2000. By State <br />grant requirements, only a government entity may apply. The group has also requested the School <br />District's permission to place the lights at Colton Middle School. The Soccer Organization will be <br />responsible for the bulk of the work required to complete the grant. <br />One of many requirements of the grant is a Joint Use Agreement between the City and the School District <br />for Colton Middle School. The proposed Agreement developed by the District is attached. Important <br />components of that Agreement include: <br />• Use of Colton Middle School playfields shall be subject to reasonable rules and regulations as <br />determined by the District. <br />• Each party to this Agreement holds the other harmless from all claims or lawsuits. <br />• District will be responsible for the upkeep of the fields. <br />• Agreement is null and void should the City be unsuccessful in its application for the grant. <br />• The Agreement remains in force for a period of not less than 20 years. However, it can be <br />terminated by either party at the end of any traditional school year with 60 days prior notice. <br />ENVIRONMENTAL IMPACT: <br />None. <br />FISCAL IMPACT: <br />Unknown at this time. <br />
