(a) Animal Control Department Defined. "Animal control department' or "Department' 10 means the City of Colton Animal Control Department, or whatever entity performs any of the animal control functions for the City of Colton. 11 12 (b) Chief of Police. "Chief of Police" means the Chief of the Colton Police Department, or designee. 13 (c) City. "City" means the City of Colton. 14 15 (d) County. "County" means San Bernardino County. 16 (e) Enclosure. "Enclosure" means a fence or structure suitable to prevent the entry of young children, which is suitable to confine a vicious dog in conjunction with other 17 measures which may be taken by the owner or keeper of the dog. The enclosure shall be 18 designed in order to prevent the animal from escaping. The animal shall be housed pursuant to Section 597t of the Penal Code. 19 (f) Hearing Entity. "Hearing Entity" means the Code Enforcement Housing Advisory 20 Appeals Board, or such other person or entity designated by the City Manager of the City 21 to administer hearings pursuant to this Chapter. 22 (g) Impounded. 'Impounded" means taken into the custody of the animal shelter or Animal Control Department. 23 24 (h) Potentially Dangerous Dog. 'Potentially dangerous dog" means any of the following: 25 (1) Any dog that, when unprovoked, on two separate occasions within the prior 36 - month period, engages in any behavior that requires a defensive action by any person to 26 prevent bodily injury when the person and the dog are off the property of the owner or 27 keeper of the dog. 28 (2) Any dog that, when unprovoked, bites a person causing less than severe injury.
