Departmental Services Charge. <br />(a) In addition to the payment of the permit application fee, an applicant <br />shall pay the City for all City departmental service charges incurred in connection with or due <br />to the applicant's activities under the permit. Additionally, if City property is destroyed or <br />damaged by reason of the applicant's use, event or activity, the applicant shall reimburse the <br />City for the actual replacement or repair cost of the destroyed or damaged property. <br />(b) At least three (3) days prior to a parade, event or activity permitted <br />under this Chapter, the applicant shall pay to the City a deposit in an amount sufficient to <br />cover the total estimated City departmental charges which the Administrative Authority <br />estimates will be incurred in connection with the permit. <br />(c) City departments shall submit the final invoices and billings for <br />departmental charges actually incurred to the Administrative Authority no later than ten (10) <br />working days after the expiration date of the permit. <br />(d) If the deposit is less than the final charges pursuant to this Section, the <br />applicant shall pay the difference to the City within ten (10) working days of billing. If the <br />deposit is more than such final charges, the City shall refund the difference to the applicant <br />within the twenty (20) working days after the expiration of the permit. <br />5.44.160. Security for Cleanup. <br />(a) At the time of filing an application for special event the applicant shall <br />submit an agreement on a form provided by the City and signed by the applicant stating that, <br />within twenty four (24) hours after the conclusion of the special event, the applicant will <br />clean and restore or cause to be cleaned or restored to its original condition the property <br />upon which the special event is to occur and remove any notices posted pursuant to Section <br />5.44.200 of this Code. <br />(b) A designated representative of the City shall inspect the property <br />within three (3) days of the expiration date of the permit to determine whether theapplicant <br />has complied with this section. <br />(c) The City reserves the right to require the applicant to take necessary <br />measures to ensure the property is restored to the condition it existed in immediately prior to <br />the effective date of the pennit. In such an instance, the Administrative Authority shall <br />require a cash deposit or other City Attomey-approved form of financial arrangement from an <br />applicant as a condition to the issuance of a permit. The deposit shall be in the amount <br />established by resolution adopted by the City Council. <br />(d) The security deposit, pursuant to subsection (c), shall be refundable on <br />compliance with the provisions and requirements of this Chapter, including but not limited to <br />the removal of trash and debris, temporary signs, temporary circulation improvements, <br />temporary fencing, and appurtenant accessory facilities and structures and the cleanup of <br />the site.
