Chapter 5.44 currently regulates only outdoor festivals and special events, such as <br />carnivals, circuses, concerts, etc. This Ordinance, however, would provide uniform <br />permit procedures and requirements for large special events as well as smaller events <br />conducted within the City. Special events would be divided into four categories: (1) <br />major special events (i.e., carnivals, parades, festivals); (2) minor special events (i.e., <br />5k/10k races, block parties, etc.); (3) miscellaneous special events (i.e., use of any City <br />facility); and (4) park events (i.e., birthday parties or family reunions). Also, depending <br />on which category a special event falls into, different application deadlines and notice <br />requirements would apply. <br />This Ordinance would also provide the City with additional safeguards. This Ordinance <br />would require a special events applicant to: <br />(1) Pay for City departmental charges that the City may incur in connection <br />with the applicant's special event. For example, the applicant must <br />reimburse the City for the repair or replacement cost of damaged or <br />destroyed City property. <br />(2) Provide the City a security deposit for clean-up. <br />(3) Provide the City with liability and property damage insurance (except for <br />those events involving the exercise of free speech rights). <br />(4) Provide the City with a hold -harmless and indemnification agreement for <br />any claims arising out of or in connection with the special event. <br />ALTERNATIVES: <br />1. Adopt Ordinance No. Q -(z uzamending Chapter 5.44 of the Colton Municipal <br />Code. <br />2. If the City Council wishes, it may further discuss this Ordinance at the City <br />Council Workshop scheduled for September 2002. <br />3.
