APPROVED iY CITY C unci: Date q oi_ Item FIRST AMENDMENT TO THE PROFFESSIONAL SERVICES AGREEMENT FOR WATER ENGINEERING SERVICES This First Amendment to the Professional Services Agreement for water engineering services ("First Amendment") is entered into this 19s' day of February 2002 between the City of Colton ("City"), a California municipal corporation, and John Egan and Associates a corporation ("Consultant"). City and Consultant are sometimes herein referred to collectively as the "Parties." RECITALS WHEREAS, City and Consultant entered into that certain professional services agreement for water engineering services for the Design of Montecito Reservoir No. 2 Project ("Project") dated May 15, 2001 ("Original Agreement"); and WHEREAS, the term of the Original Agreement is from May 15 2001 to June 30. 2002, or until the project is complete. NOW, THEREFORE, the Parties agree as follows: AMENDMENTS 1. Section 3.3.1 (Compensation) of the Original Agreement is hereby amended to read as follows "3.3.1 ComMnsation. Consultant shall receive compensation, including authorized reimbursements, for all Services rendered under this Agreement at the rates set forth in Exhibit "C" attached hereto and incorporated herein by reference. The total compensation for the Montecito Reservoir No. 2 shall not exceed $215,000; and Desien of the Missing_ Segments in the Water Transmission Pine to the New Reservoir, per scope of services dated December 11 2001, shall not exceed 1&200 for a total compensation of $223.900 without written approval of City's Water/Wastewater Director. Extra Work may be authorized, as described below, and if authorized, will be compensated at the rates and manner set forth in this Agreement." 2 Except as specifically amended by the terms of this First Amendment, all provisions of the Original Agreement shall remain in full force and effect.
