FIRST AMENDMENT <br />TO THE PROFFESSIONAL SERVICES AGREEMENT <br />FOR WATER AND SEWER ENGINEERING SERVICES <br />This First Amendment to the Professional Services Agreement for water and sewer <br />engineering services ("First Amendment's is entered into this 19th day of February, <br />2002 between the City of Colton ("City'l, a California municipal corporation, and Krieger <br />& Stewart, a corporation (Consultant'. City and Consultant are sometimes herein <br />referred to collectively as the "Parties." <br />WHEREAS, City and Consultant entered into that certain professional <br />services agreement for water and sewer engineering services for the FY 00-01 Water <br />and Sewer Line Replacements, Phase I Project ("Project's dated November 7, 2000 <br />("Original Agreement'); and <br />WHEREAS, the term of the Original Agreement was from November 7, <br />2000 to June 30, 2001; and amended on July 17, 2001 to extend the contract <br />completion date to September 30, 2002; and <br />WHEREAS, due to the addition of six alleys and one street to the Project, <br />City and Consultant desire to amend the Original Agreement to extend the term in order <br />to allow Consultant to perform the water and sewer engineering services. <br />NOW, THEREFORE, the Parties agree as follows: <br />AMENDMENTS <br />1. Section 3.1.2 (Term) of the Original Agreement is hereby amended <br />to read as follows: <br />"3.1.2 Term. The term of this Agreement shall be from November 7, <br />2000 to November 30, 2002, unless earlier terminated as provided herein. Consultant <br />shall complete the Services within the term of this Agreement, and shall meet any other <br />established schedules and deadlines." <br />2. Section 3.3.1 (Compensation) of the Original Agreement is hereby <br />amended to read as follows <br />"3.3.1 Compensation. Consultant shall receive compensation, including <br />authorized reimbursements, for all Services rendered under this Agreement at the rakes <br />set forth in Exhibit "C" attached hereto and incorporated herein by reference. The total <br />compensation for the FY 2000-01 Water and Sewer Line Replacements, Phase I shall <br />not exceed $110.050; and Phase II pgr scope of services dated January. 2002 shall <br />not exceed $41,500 for a total compensation of $151,580 without written approval of <br />City's Water/Wastewater Director. Extra Work may be authorized, as described below, <br />and if authorized, will be compensated at the rates and manner set forth in this <br />Agreement." <br />Page 1 <br />
