Where there is more than one person responsible for a violation of <br />section, the Chief of Police or designee may in his or her discretion bill each such person for <br />portion of the public safety service fee that is attributable to such person's actions in causing <br />violation of this section. <br />(4) Any person owing a public safety service fee pursuant to this section shall, <br />addition, be liable to the City for the City's attorneys' fees and costs in any action brought by t <br />City to recover such amount or otherwise enforce this section, whether through a civil, crimi; <br />or administrative action or proceeding; provided however, that should the City chose to colli <br />the public safety service fee as a special assessment, the prevailing party shall be entitled <br />attorneys fees' and costs in any action, administrative proceeding, or special proceeding relati <br />thereto. <br />D. Violations Any person or entity found violating this section shall be subject to th <br />imposition of an administrative fine and penalty pursuant to Section 8.12.030(A)(1), provide <br />however, that notwithstanding Section 8.12.030(A)(1), additional administrative citations may b <br />issued and fines imposed for every hour or other interval of time provided by the citing offici; <br />during which the violation continues uncorrected. Any gathering in violation of Section 9.16.01 <br />shall be deemed an unlawful assembly." <br />SECTION 2. Sections 9.16.020, 9.16.030, 9.16.040 and 9.16.050 and Chapter 9.18 <br />the Colton Municipal Code are hereby deleted in their entirety. <br />SECTION 3. The City Council may establish and amend the amount of the public saf <br />service fee by resolution. Such amount shall be determined according to the reasonable cc <br />of providing the public safety service responses, including, without limitation, respond <br />personnel and other administrative expenses. <br />SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this <br />Ordinance, or its application to any set of facts, is held invalid or unconstitutional, suct <br />determination shall not affect the validity of the remaining portions of this Ordinance. The City <br />Council declares that is would have enacted this Ordinance and each section, subsection <br />sentence, clause or phrase hereof irrespective of any determination of invalidity. <br />4 <br />
