Item #5 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF July 16, 2002 <br />TO: Honorable Mayor and City Council <br />FROM: City Attorney <br />SUBJECT: Rescission of Award of Contract to AEI-CASC Engineering <br />DATE: July 16, 2002 <br />BACKGROUND: <br />On March 26, 2002, the City Council awarded a contract to AEI-CASC Engineering for <br />design services for the 2002 Measure I Project. AEI-CASC later notified the City Engineer <br />that it would not be able to accept the awarded contract. AEI-CASC declined the award <br />due to conflicts over the City's insurance requirements and required time of completion for <br />the work. <br />DISCUSSION/ANALYSIS: <br />Although the City and AEI-CASC did not actually execute a contract, a formal rescission <br />of the award is necessary since the City Council took action to award the contract. The <br />City Attorney's office drafted the attached Agreement of Rescission, in which both the City <br />and AEI-CASC waive any rights or obligations related to the award of the contract. <br />ALTERNATIVES: <br />Deny approval of the Agreement of Rescission between the City and AEI-CASC <br />Engineering. <br />2. Take no action. <br />FINANCIAL IMPACT: <br />The awarded contract was approved by City Council in an amount not to exceed <br />$122,016.00. The Council also approved amendments to the compensation, as <br />necessary, up to a maximum of $2,984.00. The rescission of the awarded contract <br />necessarily removes any obligation by the City to compensate AEI-CASC the amounts <br />mentioned above. <br />
