APPROVED BY ;fo, Date tv Item # LZ _ CITY OF COLTON and REDEVELOPMENT AGENCY FOR THE CITY OF COLTON MOUNT VERNON CORRIDOR PUBLIC WORKS PROJECTS FUNDING AND CONSTRUCTION MANAGEMENT AGREEMENT THIS MOUNT VERNON CORRIDOR PUBLIC WORKS PROJECTS FUNDING AND CONSTRUCTION MANAGEMENT AGREEMENT (the "Agreement") is dated as of June 4, 2002, by and between the City of Colton (the "City") and the Redevelopment Agency for the City of Colton (the "Agency") and is entered into in light of the facts set forth in the following Recitals: - - RECITALS - - WHEREAS, the Redevelopment Agency for the City of Colton (the "Agency") may, with the consent of the City Council of the City of Colton (the "City"), pay for all or a part of the cost of the installation and construction of any building, facility, structure or other improvement which is publicly owned either within or outside of the redevelopment project area of the Mount Vernon Corridor Redevelopment Project (the "Project Area") as set forth in Health and Safety Code Section 33445; and WHEREAS, the Agency has issued its $5,290,000 Mount Vernon Corridor Redevelopment Project 1999 Tax Allocation Bonds (the "Bonds") to provide financing for, among other things, the installation and construction of public improvements situated within or of benefit to the redevelopment project area of the Mount Vernon Corridor Redevelopment Project; and WHEREAS, the City Council has previously adopted its Resolution No. R-26-00 dated April 4, 2000, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON MAKING CERTAIN FINDINGS UNDER HEALTH AND SAFETY CODE SECTION 33445 CONSENTING TO THE PAYMENT BY THE REDEVELOPMENT AGENCY FOR THE CITY OF COLTON OF TAX INCREMENT FUNDS FOR THE ACQUISITION, INSTALLATION AND CONSTRUCTION OF PUBLIC IMPROVEMENTS WHICH BENEFIT THE MT. VERNON CORRIDOR REDEVELOPMENT PROJECT (1999 TAX ALLOCATION REVENUE BONDS)" and; SB2002:1 O853.1
