(CH2M5IILL) has prepared this letter on behalf of Kinder Morgan Energy <br />Partners, L.P. (KMk:P) to request permission from the City of Colton, (City) for an <br />encroachment and street cut permit. This request is related to work being performed at the <br />Calnev Pipe Line Company, L.LC. (Calnev) Colton Fuels Verminal located at 2051 Bast <br />Slover, Bloomington, California, Calnev is an operating partnership of KMEP, <br />The purpose for this request is to drill and install one groundwater monitoring well as part <br />of a site investigation being conducted by KMEP in association with the State of California <br />Regional Water Quality Control Board (RWQCB). In addition, KMEP will excavate three <br />trenches across East Slover Avenue to expand a free product recovery system can tly in <br />operation at the Calnev Colton Fuels Terminal For KMEP to meet the schedule agreed to <br />with the RWQCB, this work will need to be completed during the month of June 2002. The <br />work will be done in two stages as outlined below: <br />Stage 1- Within the endangered species habitat area extending from the south edge of <br />Slover Avenue up to the two monitoring wells (EMW-2 and MW -1). Tentative schedule <br />start date for field work is May 2$, 2002. For this stage of field work, a street cut permit <br />is requested. A traffic control plan for this stage of work is provided in Attachment A. <br />Stage 2 - Between the south edge of the Calnev Colton Terminal to the south edge of <br />Slover Avenue (EMW-2, MW -1, and EMW-5). Tentative schedule start date for field <br />work is June 10, 2002. For this stage of field work, an encroachment permit is requested <br />in addition to street closure for a period of two weeks from midnight Sunday, June 9 <br />though midnight Sunday June 23, 2002. A traffic control plan for this stage of work is <br />provided in Attachatent A. <br />KMEP has met with the U.S. Department of Fish and Wildlife (DFW) to discuss any impact <br />this work would have on the endangered Delhi Sands Flower -Loving Fly. DFW personnel <br />have determined that the paved portion of Slover Avenue and the unpaved area <br />immediately north of the road are not considered as wildlife habitat for the Delhi Sands <br />
