CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF MARCH 26. 2002 <br />Honorable Mayor and City <br />City Attorney's Office <br />SUBJECT: Appeal to the City Council regarding the Code Enforcement Housing and <br />Appeals Board Commission's decision regarding Public Nuisance <br />conditions at 2081 Placentia Lane (3779 W. Placentia Lane) <br />DATE: March 13, 2002 <br />BACKGROUND: <br />On December 5, 2001, the Code Enforcement Housing and Appeals Board held a Regular <br />Meeting to determine if the property located at 2081 Placentia Lane (3779 W. Placentia Lane) <br />had Public Nuisance conditions. After receiving public testimony, the Board adopted the <br />findings and recommendations of the Staff's Report. <br />On December 17, 2001, the Code Enforcement Housing and Appeals Board held a Special <br />Meeting and adopted Resolution No. R-27-01 regarding Public Nuisance conditions at 2081 <br />Placentia Lane (3779 W. Placentia Lane). <br />On January 15, 2002, the property owner filed an appeal of the Code Enforcement Housing and <br />Appeals Board's decision adopting Resolution No. R-27-01. The Appeal was originally <br />scheduled for hearing on February 5, 2002. However, Mr. and Mrs. Stark agreed to continue <br />the hearing to February 19, 2002, by letter dated February 5, 2002 (Attachment A). <br />The City Attorney's Office held a meeting with Mr. and Mrs. Stark and their counsel, Dan G. <br />McKinney, on February 12, 2002, to discuss settlement. Mr. and Mrs. Stark again agreed to <br />postpone the February 19, 2002 hearing until March (Attachment B). <br />DISC USSION/ANALYSIS: <br />The City Attorney's Office has been in the process of negotiating a Settlement Agreement with <br />the property owners, Mr. and Mrs. Stark, since the February 12, 2002 meeting. The negotiations <br />are nearing completion, ans staff expects to present the proposed settlement soon. <br />ALTERNATIVES: <br />Deny the appeal by the owner and uphold the Code Enforcement Housing and Appeals Board <br />adoption of Resolution R-27-01. <br />RECOMMENDATION: <br />Staff recommends that the City Council 1) continue the public hearing to April 16, 2002 to allow <br />the City Attorney's Office to continue to negotiate a settlement with Mr. and Mrs. Stark. <br />
