TO: <br />FROM: <br />CITY OF COLTON Item #8 <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF MAY 7, 2002 <br />Development Director <br />SUBJECT: Resolution Authorizing Amending and Updating the City's California <br />Environmental Quality Act (CEQA) Guidelines. <br />DATE: April 22, 2002 <br />BACKGROUND: <br />Annually, the City receives updates to the California Environmental Quality Act (CEQA) Guidelines. <br />These updates are provided to us by the offices of Best, Best and Krieger (BB&K), attorneys for the <br />City of Colton. It has been standard practice for the City to adopt the updates by City Council <br />Resolution, so that we will remain in compliance with State Environmental Law. <br />DISCUSSION/ANALYSIS: <br />The City Council is requested to adopt the attached Resolution amending and adopting Local guidelines <br />for implementing CEQA, and repeal earlier Resolutions addressing the same. <br />The proposed amendments are consistent and compatible with the policies of the State of California and <br />the City of Colton. The attached memorandum from BB&K, dated March 2002, details the revisions to <br />CEQA that are relevant to the City of Colton. <br />ALTERNATIVES: <br />The City Council has the authority to deny the requested update to the City's CEQA Guidelines. To do <br />so will place the City out of compliance with the current CEQA. The requested action, if approved, <br />will keep the City in compliance with the State CEQA, and legally defensible if challenged in a court of <br />law. <br />FINANCIAL IMPACT: <br />No impact to the General Fund. The requested action is a text change only. A financial impact, <br />unknown at this time, could occur, should the City not adopt the Resolution amending CEQA <br />Guidelines, and be challenged in a court of law for CEQA non-compliance. <br />ENVIRONMENTAL IMPACT: <br />None. <br />RECOMMENDATION: <br />Staff recommends that the City Council adopt the attached Resolution, amending the City of Colton's <br />CEQA Guidelines to be consistent with the California CEQA Guidelines. <br />Attachments: Resolution <br />Best, Best and Krieger Memorandum <br />REVIEW TEAM ONLY <br />City Attorney: Id -1— A` _f--7 Finance' Director: <br />City Manager: OTHER: <br />
