The Common Use Agreement was modified with language suggested by the City Attorney, and <br />then e-mailed back to the County who approved the modification with minor changes. The final <br />draft of the agreement has now been approved by both parties and their legal advisors and is <br />attached, along with maps relating to the City's portion of the proposed work, in its approved <br />form. Upon execution of the Common Use Agreement by the City of Colton, the Agreement will <br />be returned to the County, who has agreed to furnish the City with the necessary project timeline <br />schedules prior to the start of construction. <br />ENVIRONMENTAL IMPACT <br />An Initial Assessment has been filed, for which a categorical exemption under CEQA was received, <br />and can be viewed at the San Bernardino County Regional Parks Division offices. Please contact <br />Maureen A. Snelgrove, Program Manager at (909) 387-2591. <br />FINANCIAL/FISCAL IMPACT <br />This phase of the overall SART project is being funded with TEA funds through Caltrans, <br />private non-profit funds and County match dollars. There will be no costs associated with this <br />project for the City of Colton. <br />RECOMMENDATION: <br />Staff respectfully recommends that the Council approve the execution of the attached Common <br />Use Agreement between and by the City of Colton and San Bernardino County Regional Parks <br />Division. <br />The County of San Bernardino will require six (6) sets of original, wet -signed, Common Use <br />Agreements (attached). <br />Attachments: Common Use Agreement - Six (6) original sets <br />Proposed Santa Ana River Trail Plat - Exhibit A <br />Report prepared by Dusty Dappen, Engineering Tech II. <br />REVIEW TEAM ONLY <br />City Attorney: ,P ,, -f Finance Director: <br />City Manager: `rk,;�j \ OTHER: /1 ` <br />
