In that capacity we are in receipt of your claim for the wrongful death of Raul Agredano. We have now completed our investigation into your claim by receiving and reviewing various reports within the City. The City of Colton Police Department transferred custody of your client over to the San Bernardino County Sheriffs Department shortly after his arrest with the notation your client was taking medication. Notable is that your client admitted he had not been taking his medication recently. We have recommended denial of your claim and the City will be sending you formal notice soon. Please note your client was under the care, custody and control of the San Bernardino County Sheriffs Department when his death occurred. In considering your future course of action, we remind you of the provisions of Code of Civil Procedure, Section 1038. It is not our intention to discourage filing of litigation against this public entity when there is a valid basis for doing so under the facts and law. We do not believe there is such a basis in this case. We are sure you will exercise your judgment in advising your client as to continuing this matter against the City of Colton in view of the application of CCP1038.
