March 6, 2003 <br />Page 2 <br />Court of Appeal has attempted to justify its novel interpretation of Marsh, supra, by <br />culling bits and pieces of analysis from the Supreme Court's religious display and <br />school prayer cases. None of these cases is applicable to the issue of legislative prayer, <br />which has stood alone and undisturbed in the Establishment Clause world of <br />jurisprudence since Marsh. It should be for the United States Supreme Court and not <br />the Second District Court of Appeal in California to expand, expound on, modify, <br />disapprove or overrule its Marsh decision. <br />Appellate specialist Douglas Collodel of the nationally known law firm of Sedgwick, <br />Detert, Arnold & Moran, has agreed to prepare an amicus curiae brief in support of the <br />City of Burbank's Petition for Writ of Certiorari. The amicus curiae petition will be filed <br />no later than April 18, 2003 and wili focus on the more universal and national <br />implications of this decision to public agencies throughout the country. If you would like <br />to support the City's Petition, we would ask that you fill out and return by fax or mail, the <br />attached letter of support. You may also email your support to the undersigned, at <br />dbarlow@ci.burbank.ca.us or douglas.collodel@sdma.com. <br />Experience has shown that amicus curiae support is an important factor in the Supreme <br />Court's determination to grant certiorari.
