CLARKE, ELECTRIC UTILITY DIRECTOR'-rl�C� SUBJECT: REQUEST TO ACCEPT PERMANENT EASEMENT FROM DONALD AND CHARLOTTE MARLOW FOR CONSTRUCTION, OPERATION, AND MAINTENANCE OF AN ELECTRIC POWER TRANSMISSION LINE DATE: April 07, 2003 BACKGROUND: The Engineering, Procurement, and Construction (EPC) agreement for the Agua Mansa Power Plant was approved by Council on May 21, 2002. Acquisition of right of way dedications for a transmission line corridor for the power plant is required across several parcels of property adjacent to and near the Beckett property. DISCUSSION/ ANALYSIS: The necessary grant of easement for Assessor Parcel Numbers 0260-072-01, owned by Donald and Charlotte Marlow was prepared by Best, Best, and Krieger. The property description was prepared by KCT Consultants, Inc., a civil engineering firm retained by EI Colton, the developer of the Agua Mansa Power Plant. The proposed grant of easement and a legal description of the property is attached as Exhibit "A" and "A-1". FINANCIAL IMPACT: The City of Colton has offered $2.00 per square foot to Donald and Charlotte Marlow for the easement. The total cost to the City is $32,500. Sufficient funds are available; bond money dedicated to the construction of the power plant will be used. ENVIRONMENTAL IMPACT: All items relating to the Environmental Impact Report and the requirements of CEQA have been satisfied for this project. RECOMMENDATION: Staff recommends that Council accept, on behalf of the City of Colton, the grant of easement by Donald and Charlotte Marlow, Inc. as presented. Staff also recommends that the easement be duly submitted to the San Bernardino County Recorder's Office for official recordation.
