RELEVANT FACTS <br />ABOUT THE INLAND REGIONAL MATERIAL RECOVERY FACILITY (MRF) <br />➢ Under the existing Conditional Use Permit (CUP) granted in 1999, the MRF is permitted to <br />accept and process up to 1,950 tons per day of source -separated, comingled recyclable <br />materials. <br />➢ The MRF has been operating under the approved CUP, and engaging in these processing <br />activities since April 2002. <br />➢ The proposed Project is solely to amend the existing CUP to grant the MRF the right to <br />accept mixed Municipal Solid Waste (MSW) from existing and future customers, and to <br />amend the Specific Plan to clarify this use. <br />➢ The City of Colton Planning Commission previously approved this Project; but, after a <br />business competitor of Taormina's challenged the Project under CEQA, the Court required <br />the City to take back its previous approval of the Project, the Mitigated Negative Declaration <br />(MND), and the mitigation monitoring and reporting program based on one procedural <br />technicality. <br />➢ This CUP modification does not change any other aspect of the operation of our facility, and <br />does not represent any increase in previously -approved traffic, construction or capacity: <br />❖ The types and quantities of trucks and vehicles entering and leaving the MRF will remain <br />the same. <br />❖ The size and location of buildings (existing and planned) at the MRF will remain the <br />same. <br />❖ The total eventual intake tonnage of 1,950 tons per day will remain the same. <br />➢ One comment received pertains to potential odors. This project includes proven odor control <br />measures, including limited hold times, MSW in enclosed buildings, odor neutralizers and <br />eventual greenwaste processing under a covered building. <br />➢ Another comment received pertains to the updated traffic study. Subject intersections were <br />identified based on the previously approved traffic study. The purpose of updating the study <br />was to account for current operations and possible changes to traffic patterns in the relevant <br />area of operations. No additional routes or intersections were added as a result of this <br />Project. <br />➢ On the basis of the Initial Study/MND and the substantial evidence supporting the <br />documents' conclusions, the City's Staff has determined that the Project will not have a <br />significant effect on the environment, and has prepared a Draft MND. <br />➢ An Environmental Impact Report (EIR) is only required where a project (1) has the potential <br />to cause a significant effect on the environment, and (2) where that potential cannot be <br />mitigated to a less than significant level. Since these conditions do not exist for this project, <br />a MND is the appropriate CEQA document. <br />Facility Address: 2059 West Steel Road, Colton, California <br />
