(Emphasis <br />added.) <br />In particular, this appeal stems from the May 16, 2003, determination that only <br />employees in the above listed position would be eligible to vote in the election. Accordingly, the <br />June 23, 2003, appeal is untimely in that it was not filed within the 10 day period required under <br />Section 6, Rule 1, Subsection F of the Employer -Employee Relations Policy. <br />Accordingly, it is recommended that the City Council deny the appeal and uphold <br />adopt the initial decision the position listed above constitute an appropriate bargaining unit and <br />that only employees in those positions were eligible to vote in the June 11, 2003, election. <br />Findings of Fact- Appeal 071503 <br />
