CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF DECEMBER 16, 2003 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />APPROVED: AL HOLLIMAN, ASSISTANT CITY MANAGE <br />2e <br />FROM: ANTHONY ARROYO, ADMINISTRATIVE ANALYST II <br />f <br />SUBJECT: MOU HOUSEKEEPING ITEMS <br />DATE: DECEMBER 8, 2003 <br />BACKGROUND: <br />Item #10 <br />Since the General Unit negotiations were completed in 2001, there have been significant changes <br />affecting most of the other bargaining units Memoranda of Understanding. Recently, an IRS <br />Section 125 plan was implemented. As such, language reflecting this benefit package needs to be <br />included in most of the MOUs (to date, all bargaining groups with the exception of the IBEW and <br />Water/Wastewater units are participating in the cafeteria plan). In addition, the new language <br />pertaining to the Retiree Medical allowance is being added to those bargaining groups who have <br />agreed to language clarification. <br />Because of the need to add the Section 125 and Retiree Medical language to the MOUs, staff <br />added language that has been consistent with other bargaining groups who have recently <br />completed negotiations with the city. Such changes include stipulating when bilingual pay is to be <br />paid to those employees receiving such pay; increasing the amount for long-term disability, and <br />increasing the tuition reimbursement for the Executive Unit to be consistent with all other MOUs. <br />(Please refer to Exhibit A.) <br />In addition to the above, and because some changes may occur between negotiation sessions, <br />staff is seeking Council's approval to provide the City Manager (also referred to as the Personnel <br />Officer) with the authority to sign off on any housekeeping changes to MOU language, if needed, <br />once the city and a bargaining group have met and conferred to any language changes. Council <br />approval will still be required when a contract is negotiated. <br />DISCUSSION/ANALYSIS: <br />In as much as the city will be negotiating with four bargaining groups in 2004, the above changes <br />are warranted in order to keep all MOU language consistent with recently imposed enhancements <br />to the city's benefits plan. At the same time, staff moved forward to keep language consistent with <br />what has been agreed to by other bargaining groups during the negotiating session this past <br />summer. It should be noted that nothing is being taken away as far as benefits or perquisites -the <br />changes reflect enhancements to the current language. Staff determined these changes were <br />also necessary in order to maintain the consistency with all MOUs due to the recent changes <br />pertaining to the health and retiree benefits. <br />For this one item only, the City Manager (or his designee), will be authorized by Council to sign <br />documents to approve the housekeeping changes to all MOUs impacted by language clarification. <br />
