Daryl J. Parrish, City Manager
January 14, 2003
Page 3
Vl statement. I have received this statement from the United States Marshal's Office. A copy is
'• enclosed for your review. I will be making a motion to enforce the stipulation to require the
/ monthly disclosure to be made to the City and I will seek to have McCook and his attorney held
in contempt for non-compliance of the court order. At the same time, McCook's attorney will be
making a motion to dismiss the City and Agency from the forfeiture action, as well as the
stipulation based on the argument that there is no "standing" to participate in the forfeiture
action. These motions will be filed next week. The hearing date of these motions is March 3,
2003 at 10:00 a.m. before Judge Phillips in Riverside.
If you have any questions, please call me.
Very truly yours,
BAR: lsk
Enclosures
cc: Dean Derleth, City Attorney (w/ encls.)
