Item #20 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR CITY COUNCIL MEETING OF July 15, 2003 <br />TO: Honorable Mayor and Council Members <br />FROM: Tammye Dunn, Community Projects Manager <br />SUBJECT: Use of Alcoholic Beverages at Fleming Park — EARP Society <br />DATE: Tuesday, July 08, 2003 <br />BACKGROUND <br />The EARP Society submitted a facility reservation request for the use of Fleming Park on Saturday July 26, <br />2003. This request was approved by the City Council on July 1, 2003. Additional approval is being requested <br />for the use of alcoholic beverages, to be served at the Old West Days Fundraiser <br />DISCUSSION/ ANALYSIS <br />City Ordinance No. 0-14-96, 12.24.110, provides for the consumption of alcohol in city parks only for special <br />events of corporations or public entities (such as the city) subject to City Council approval. Following are key <br />provisions of the ordinance and related ordinance 9.84, 9.20.055 <br />Ordinance No. 0-14-96,12.24.110, Alcoholic beverages from the City's Municipal Code: <br />"No person shall consume or have in his possession, custody or control, either open or unopened, any <br />alcoholic beverage of any kind whatsoever, except when attending a function operating under an alcohol <br />permit issued in accordance with Chapter 9.84 of this code. No intoxicated person shall enter, be or remain in <br />any park." <br />Chapter 9.84, Section 9.20.055, (Officially sanctioned special events --Permit requirement) of the code <br />reads, "Notwithstanding any other provision of this chapter, drinking or consuming alcoholic beverages may be <br />allowed at officially sanctioned special events so long as such drinking or consuming of alcoholic beverages <br />occurs only pursuant to a permit issued in accordance with this section and only in enclosed public places, <br />including without limitation enclosed areas within public parks. Officially sanctioned special events shall be <br />those events sponsored by qualified and insured businesses, corporate or public entities for which a permit has <br />been issued. The City and the Redevelopment Agency shall at all times be deemed to be a qualified and <br />insured public entity for purposes of this section. Application for a permit to hold an officially sanctioned <br />special event at which alcohol will be served shall be made through the Community Development Department <br />and must be approved by the City Council at a public meeting. All such events must comply fully with any <br />applicable rules or regulations of the California Alcoholic Beverages Control Board.
