R-19-03 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON, CALIFORNIA, PURSUANT TO <br />GOVERNMENT CODE SECTION 21156, MAKING <br />DETERMINATION OF DISABILITY STATUS FOR <br />LOCAL SAFETY EMPLOYEE MARK JOSEPH <br />SCHULTEHENRICH <br />WHEREAS, THE City of Colton (hereinafter referred to as Agency) is a contracting <br />agency of the Public Employees' Retirement System; and <br />WHEREAS, The Public Employees' Retirement Law requires that a contracting <br />agency determine whether an employee of such agency is in employment in which he is <br />classified as a local safety member; is disabled for purposes of Public Employees' <br />Retirement Law; and, <br />WHEREAS, the City Council confirms that a worker's Compensation Claim was <br />filed by Mark J. Schultehenrich alleging disability from his position as Police Officer and <br />whether such disability is "industrial" within the meaning of such law; and, <br />WHEREAS, the City Council has reviewed the medical and other evidence relevant <br />to such alleged disability. <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />The City of Colton hereby finds and determines that Mark J. Schultehenrich was <br />rendered incapacitated within the meaning of the Public Employees' Retirement Law for <br />performance of his duties in the position of Police Officer, that the disability was the result <br />of illness or disease, specifically, lower back strain, under the provisions of Government <br />Code Section 21156; and, <br />
