R-20-03 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, <br />AUTHORIZING THE SUBMITTAL OF A GRANT APPLICATION, THE INCURRING <br />OF AN OBLIGATION, THE EXECUTION OF AN AGREEMENT AND ANY <br />AMENDMENTS THERETO, AND ANY OTHER DOCUMENTS NECESSARY TO <br />SECURE A CEGP GRANT FROM THE STATE OF CALIFORNIA, DEPARTMENT <br />OF HOUSING AND COMMUNITY DEVELOPMENT <br />WHEREAS, The City of Colton, a city within the State of California, wishes to <br />apply for and receive an allocation of funds through the Code Enforcement Grant <br />Program; and <br />WHEREAS, The California Department of Housing and Community <br />Development (herein referred to as "HCD") has issued a Notice of Funding <br />Availability ("NOFA") for the Code Enforcement Grant Program established by SB <br />1227 Burton (Chapter 26 of the Statutes of 2002), Health and Safety Code section <br />53533(a)6. Pursuant to the statute, HCD is authorized to approve funding allocations <br />for the program, subject to the terms and conditions of the NOFA and program <br />application forms. <br />NOW, THEREFORE, THE CITY OF COUNCIL DOES HEREBY RESOLVE AS <br />FOLLOWS: <br />SECTION 1: The City of Colton shall submit to HCD an application to <br />participate in the Code Enforcement Grant Program in response to the NOFA <br />issued February 14, 2003 which will request a funding allocation in an amount <br />not to exceed $300,000.00 for the purchase of the capital assets identified in <br />the application to be used in the City of Colton. The application also commits <br />the applicant to use, support, and maintain the capital assets acquired with the <br />grant funds for at least three years. <br />SECTION 2: If the application for funding is approved, the City of Colton <br />hereby agrees to use the funds for eligible capital asset(s) in the manner <br />presented in the application as approved by HCD and in accordance with the <br />NOFA and application package. It also may execute any all instruments <br />required by HCD for participation in the Code Enforcement Grant Program. <br />1 <br />
