CLARKE, ELECTRIC UTILITY DIRECTOR ( C_ SUBJECT: REQUEST TO ACCEPT PERMANENT EASEMENT FROM THE COUNTY OF SAN BERNARDINO FOR CONSTRUCTION, OPERATION, AND MAINTENANCE OF AN ELECTRIC POWER TRANSMISSION LINE DATE: April 23, 2003 The Power Sales agreement with NM Colton Genco, LLC for 1.2 MW was approved by Council on December 3, 2002. Acquisition of right of way dedication for connection from the landfill gas electric generating plant to our distribution system is required across several parcels of San Bernardino County property. DISCUSSION/ ANALYSIS: The necessary grant of easement for the parcels owned by the County of San Bernardino was prepared by counsel for the County of San Bernardino. The property description was prepared by Brown, Vence, and Associates, a civil engineering firm retained by NM Colton Genco, LLC, the developer of the landfill generating plant. The grant of easement was signed by Dennis Hansberger, Chairman of the County Board of Supervisors on April 8, 2003. The proposed grant of easement as signed by officials of the County of San Bernardino and a legal description of the property is attached as Exhibit "A". FINANCIAL IMPACT: This grant of easement by the County of San Bernardino is given at no cost to the City of Colton. ENVIRONMENTAL IMPACT: All items relating to the Environmental Impact Report and the requirements of CEQA have been satisfied for this project. RECOMMENDATION: Staff recommends that Council accept, on behalf of the City of Colton, the grant of easement by the County of San Bernardino as presented. Staff also recommends that the easement be duly submitted to the San Bernardino County Recorder's Office for official recordation.
