Release.
<br />2.1 In exchange for the consideration described herein in Paragraph 1, PLAINTIFFS, for
<br />themselves and for their respective heirs, legal successors, assigns, grantees, agents, tenants,
<br />representatives, attorneys, officers, directors, pa�tners, affiliates, subsidiaries, employees, and associates,
<br />do hereby forever (a) waive and release any and all claims, demands, actions, causes of action,
<br />obligations, costs, expenses, attorneys' fees, expert witness or consultant fees, damages, interest, losses
<br />and liabilities of whatsoever nature, character or kind, whether known or unknown, suspected or
<br />unsuspected, matured or contingent, that (i) concern or relate in any way to the ACTION and (ii)
<br />concern or relate in any way to the construction of the PROJECT, and (b) discharge TURNER, its
<br />agents, servants, employees, attorneys, representatives, predecessors, successors, assigns and assignors,
<br />officers and directors, attorneys, insurance carriers, and each of them, from any and all claims, demands,
<br />actions, causes of action, obli gations, costs, expenses, attorneys' fees, expert witness or consultant fees,
<br />damages, interest, losses and iiabilities of what'soever nature, character or kind, whether known or
<br />unknown, suspected or unsuspected, matured or contingent, which (i) concern or relate in any way to the
<br />ACTION and (ii) concern or relate in any way to the construction of the PROJECT.
<br />2.2 General Release of Civil Code § 154 .
<br />PLAINTIFFS acknowledge that they are familiar with California Civil Code § 1542, which
<br />provides as follows:
<br />"A general release does not extend to claims which the creditor does not know or suspect to exist
<br />in his favor at the time of executing the release, which if known by him, must have materially
<br />affected his settlement with the debtor."
<br />PLAINTIFFS waive and relinquish any and all rights and benefits that they may have under, or that may
<br />be conferred upon them by the provisions of Civil Code § 1542, to the fullest extent that they may
<br />lawfully waive such rights or benefits pertaining to the subject matter of the releases provided herein. In
<br />connection with such waiver and relinquishment, PLAINTIFFS hereby acknowledge that they are aware
<br />that they and/or their attorneys may hereafter discover claims or facts in addition to or different from
<br />those which they now know or believe to exist with respect to the subject matter of the release provided
<br />in Paragraph 2.
<br />3. Compromise.
<br />This Agreement and the releases contained herein affect the compromise and settlement of
<br />disputed and contested claims and nothing contained herein shall be construed as an admission by any
<br />party hereto of any liability of any kind to any other party. Each of the PARTIES hereby expressly
<br />denies that they are in any way liable or indebted to any other party to this Agreement.
