I ORDINANCE NO. 0-22-03 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON AMENDING SECTION 12.24.140 OF THE COLTON 3 MUNICIPAL CODE AND ADDING SECTION 12.24.141 TO THE COLTON MUNICIPAL CODE TO AUTHORIZE COMMUNITY 4 SPONSORSHIP PROGRAMS IN PARKS AND COMMUNITY SPORTS FACILITIES 5 6 7 WHEREAS, the city council of the City of Colton desires to permit advertising in city parks and community sports facilities in accordance with a community sports facility 8 sponsorship program authorized by the city council, in order to provide a financial mechanism to 9 support community sports activities and encourage civic pride; and 10 WHEREAS, the Colton Municipal Code currently prohibits all signs in parks, with 11 the exception of signs posted by concessionaires holding leases with the city; and 12 13 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLTON AS FOLLOWS: 14 15 SECTION 1. Section 12.24.140 of the Colton Municipal Code is hereby deleted in 16 its entirety and restated to read as follows: 17 "12.24.140 Advertising. No person shall announce, advertise, or call the public 18 attention in any way to any article or service for sale or hire, or paste, glue, tack or otherwise post 19 any sign, picture, placard, advertisement or inscription whatever on any city park or community sports facility." 20 21 SECTION 2. Section 12.24.141 is hereby added to the Colton Municipal Code to 22 read as follows: 23 "12.24.141 Advertising Exceptions. Section 12.24.140 shall not apply to any 24 concession or lessee operating under a lease granted by the city council, or to any advertising placed 25 within a community sports facility pursuant to a community sports facility sponsorship program approved by resolution of the city council. In approving any such resolution, the city council shall 26 first determine that the sponsorship program is not contrary to the health, safety and welfare of the 27 residents of the City of Colton or materially injurious to adjacent properties. As used herein, a 28 community sports facility shall be any facility, area or enclosure on land owned by the city and used, in whole or in part, for organized community sporting events."
