First Amendment <br />Sports Park Structures Lease <br />City of Colton/Big League Dreams Colton, LLC <br />Tenant shall agree to negotiate in good faith to determine an appropriate apportionment <br />for the payment of Increased Amount Payments." <br />3. New Section 7(f). The following is added as a new Section 7(f) to the <br />Agreement: <br />"f. Exterior Wall Signage Not later than three (3) months prior to the <br />Term Commencement Date, Tenant shall develop a Community Sports Facility <br />Sponsorship Program which shall include, as one component of the sponsorship to be <br />offered to Community Sports Facility Sponsors, the right to have interstate highway <br />facing signage on the back of the replica wall features of the Sports Park. Tenant shall <br />diligently and in good faith seek to secure all necessary permits or authorizations from <br />all governmental authorities or agencies having jurisdiction over exterior signage at the <br />Sports Park, which may be visible from interstate highways. The parties acknowledge <br />that the Municipal Code of the City of Colton does not authorize such a program and <br />that implementation of such a program is contingent upon City approval of an <br />amendment to its Municipal Code. The City agrees to diligently process and consider <br />such an amendment." <br />4. Amendment to Section 9(a) Section 9(a) of the Agreement is amended <br />as follows. The intended completion date of "May 1, 2003" is amended to "September <br />1, 2004" both times it is used. The date Tenant shall have the option to terminate the <br />Agreement if construction is not completed is amended from "November 1, 2004" to <br />"March 1, 2006". <br />5. Amendment to Section 14(c)(i) The phrase "but excluding damage due to <br />flood or earthquake." in the seventh line of Section 14(c)(i) is amended to read "but <br />excluding damage due to flood, earthquake or terrorism." <br />6. Amendment to Section 19 The address of Tenant for notice purposes set <br />forth in Section 19 of the Agreement is amended to read: <br />"If to Tenant, to: Big League Dreams Colton, LLC <br />16339 Fairfield Ranch Road <br />Chino Hills, California 91709 <br />Attention: Scott Parks LeTellier" <br />7. Amendment to Section 31(o) Referring to the recordation of the <br />Memorandum of Lease, the phrase "within thirty (30) days after the execution of this <br />Agreement" in the last line of Section 31(o) of the Agreement is amended to read "within <br />thirty (30) days after the Term Commencement Date, as defined in Section 1 <br />4 <br />
