Item #17 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF DECEMBER 7, 2004 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHER, P.E., CITY ENGINEER :* <br />SUBJECT: APPROVE RESOLUTION AND NOTICE TO PUBLIC FOR <br />DISADVANTAGED BUSINESS ENTERPRISE (DBE) PROGRAM FOR <br />FEDERAL FISCAL YEAR OCTOBER 1, 2004 TO SEPTEMBER 30, 2005. <br />DATE: NOVEMBER 24, 2004 <br />BACKGROUND: <br />In 1984, City Council first adopted the Disadvantaged Business Enterprise (DBE) Program as <br />required by Federal Regulations. The program defines disadvantaged businesses and percentage <br />goals for federally funded or assisted public works contracts to be awarded each year. The <br />California Department of Transportation (CalTrans) has been entrusted with local agency oversight <br />responsibility for DBE implementation since 1999, and as such, has the responsibility of overseeing <br />Colton's DBE Program. <br />New Federal Regulations (49 CFR Part 26) governing the DBE Program became effective March 4, <br />1999. Part 26 replaced Part 23, Title 49 of the California Federal Regulations (CFR), as the final <br />rule binding on all recipients of Department of Transportation (DOT) funded or assisted contracts. <br />In July 2000, CalTrans received approval from the Federal Highway Administration (FHWA) of <br />the local assistance procedures needed to implement the new regulations. Previous DBE <br />requirements (49CFR23) are now superseded by the new regulations (49CFR26). <br />Colton has several Federally funded or assisted CIP projects scheduled for 2004-2005, such as <br />Community Development Block Grant (CDBG) projects, Air Quality Congestion Mitigation & Air <br />Quality (CMAQ) Improvement Program projects, and a Transportation Equity Act for the 21st <br />Century (TEA -21) project. In order for the City to continue to receive Federal funding for said <br />projects, the goals for the City's DBE Program must be reviewed and revised each Federal Fiscal <br />Year (FFY). <br />ANALYSIS/DISCUSSION: <br />The City of Colton routinely solicits public bids for CIP Projects throughout the year; a good <br />percentage of these projects are federally funded, such as the Community Development Block <br />Grant (CDBG) Projects. The City expects to publicly bid, perform design -engineering, construct or <br />to have Preliminary Environmental Studies (PES) and/or design -engineering performed for these <br />projects. <br />
