Clarke, Utilities Director cell �VV-TYJC/ <br />0 <br />SUBJECT: APPROVAL OF REPLACEMENT OF RESOLUTION NO. R-67-96 NET ENERGY METERING WITH <br />RESOLUTION NO. R -XX -04 TO COMPLY WITH CURRENT CALIFORNIA PUBLIC UTILITIES CODE <br />DATE: January 13, 2004 <br />BMKGIRQUND <br />In June 18, 1996, the City of Colton approved a resolution No. R-67-96 allowing net metering of photovoltaic <br />(solar electric) generation from Colton Electric Utility's customers. Current California Public Utilities Code <br />Section 2827 has more details about the requirements for metering, billing, and interconnection that provide <br />additional protections for the utility and customer than the preexisting resolution. A new resolution R -X-04 <br />(ATTACHMENT 1) has been written that follows the requirements in the California Public Utilities Code and <br />Colton Electric Utility seeks to replace R-67-96 with R -XX -04 in the Colton Electric Utility's Customer Service <br />Policy so that written policy conforms to the applicable rules, regulations, and laws. <br />DISCUSSIOU L AMLYSIS <br />The current California Public Utilities Code has changed the requirements for net metering from Colton`s <br />existing regulations by: <br />1. Including all commercial, industrial, and agricultural service customers including Demand and Time of Use <br />meters and rates to be eligible to participate in net metering instead of just residential customers with single <br />phase non -demand meters. <br />2. Including wind as well as photovoltaic (Solar electric) systems. <br />3. Expanding size of maximum size of solar and/or wind system from 10 kW to 1000 kW. <br />4. Changes the kWh rate from a fixed amount in the tariff to the amount that would be charged to any <br />customer in the same class without net metering. <br />5. The anniversary period for annual determination of net energy consumption or production has been set as <br />one year from the beginning of net metering instead of first day of calendar year. <br />6. At the end of the annual billing period if the customer has a net energy credit the Utility does not have to <br />pay the customer for the energy unless the Utility has a power purchase agreement with the customer. <br />7. Requires the Utility to make application for net metering available over the Internet and to process <br />applications with -in a certain time period. <br />The City of Colton Public Utilities Commission has reviewed and approved these amendments to the Colton <br />Electric Utility's Customer Service Policy on February 9, 2004. <br />ALURNAMES <br />The City can be out of compliance with the California Public Utilities Code and not provide customers benefits <br />available to customers in other electric utility service areas in the State of California. <br />Page 1 of 2 <br />
