CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF JANUARY 20, 2004 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: KENNETH RULON, CHIEF OF POLICE <br />Item #1 <br />SUBJECT: ORDINANCE AMENDING CHAPTER 7.08 OF THE COLTON <br />MUNICIPAL CODE TO ALLOW ANIMAL -RELATED FEES TO BE SET <br />BY RESOLUTION <br />DATE: JANUARY 8, 2004 <br />BACKGROUND: <br />Fees for various animal -related services are currently established by ordinance, in <br />Chapter 7.08 of the Colton Municipal Code. Since these fees have not been adjusted <br />since 1968, they do not cover the City's costs of providing these services. The <br />proposed ordinance would remove the specific fee amounts currently found in Chapter <br />7.08 and allow these fees to be set by resolution of the City Council. <br />DISCUSSION/ANALYSIS: <br />The Colton Police Department has reviewed the costs incurred by the City in connection <br />with providing various animal -related services. Based upon this review, the Police <br />Department has concluded that the current fees charged for these services are woefully <br />inadequate, failing to recoup more than a small fraction of the City's actual costs. <br />Chapter 7.08 of the Colton Municipal Code establishes specific fees, but the ordinances <br />in question were adopted in 1968 and have apparently never been amended. The result <br />is that the fees have apparently not been adjusted in 35 years. <br />The proposed ordinance would delete the specific fee amounts currently found in Chapter <br />7.08, which range from ten cents to three dollars, and provide that the fee amounts will be <br />set by resolution of the City Council. This will provide greater flexibility to the City in <br />setting the fees, as it is easier and faster for the City Council to adopt a new fee resolution <br />than it is to adopt a new ordinance setting fees. Having these fees set by resolution is <br />also part of the City's overall plan to have fees set by resolution where possible. The City <br />Council would retain control over fees, and the specific fee amounts would still be set by <br />the City Council. If the proposed ordinance is adopted, a resolution will be presented to <br />the City Council at a later date to set the various animal -related fees. <br />ALTERNATIVES: <br />Adopt Ordinance providing that fees for animal -related services will be set by <br />resolution. <br />2. Direct staff to revise the proposed ordinance pursuant to Council discussion. <br />
