Zamora, Community Development Director <br />SUBJECT: Appeal to the City Council regarding the Planning Commission's decision <br />to deny File Index Number DAP -000-275, a request for chain link fencing <br />at 1537 Macy Avenue. <br />DATE: June 3, 2004 <br />BACKGROUND: <br />Alonza and Rhonda Scott ("applicant"), owners and residents of the property located at 1537 Macy <br />Avenue, were cited by the Code Enforcement Division of the Police Department for constructing a <br />chain link fence along the front and north side property lines, without City approval by the Design <br />Review Committee (DRC) and without obtaining a Building Permit. Section 18.38.050 of Title 18 <br />of the Colton Municipal Code (Zoning Ordinance) requires review and approval by the DRC for the <br />placement of chain link fencing in all residential and nonresidential zones within the City. <br />Subsequent to the action by Code Enforcement, the applicant submitted an application for DRC <br />review and approval of the chain link fencing. On April 5, 2004, the DRC denied the applicant's <br />request. The applicant appealed the denial to the Planning Commission. On April 27, 2004, the <br />Planning Commission upheld the DRC's decision and denied the applicant's request. <br />The applicant is now appealing the Planning Commission's denial to the City Council. <br />ANALYSIS/DISCUSSION: <br />The applicant resides at 1537 Macy Avenue, and stated that they were unaware of the City's <br />regulations regarding the placement of chain link fencing and a requirement to obtain a building <br />permit. According to the applicant, the fence was constructed for child safety reasons, because they <br />operate a licensed childcare business and also because it was the least costly fence to construct. <br />Unfortunately, there is no other chain link fencing along Macy Avenue, which was the primary <br />reason that the applicant's request was denied by both the DRC and the Planning Commission. The <br />Commission requested that the applicant consider the placement of wrought iron fencing or any <br />other type of fencing that is more aesthetically pleasing and consistent with the residential <br />properties along Macy Avenue. However, the applicant stated that the cost to install wrought iron <br />fencing was too much and that was their reason for installing chain link fencing. <br />
