• Holding a protest hearing to accept any written protests received from
interested parties. (Gov. Code, § 37424.)
If no protests are received, or if the city council votes to overrule the protest by a 4/5
majority, the council may proceed with the sale. (Gov. Code, § 37425.)
As noted above, the first step in this process is the adoption of a resolution finding that
the public interest and convenience require the sale of the Tiger Rescue property and
announcing the City's intent to sell it. Thus, a resolution containing these findings has
been prepared for adoption by the City Council.
FINANCIAL IMPACT:
Unknown. The City would gain the purchase price of the property minus sale costs and
broker fees. The purchase price of the property would depend upon an offer received.
ENVIRONMENTAL IMPACT:
This action is covered by an exemption under the California Environmental Quality Act
("CEQA") for projects for which there is no possibility of a significant impact on the
environment. Thus, pursuant to Public Resources Code section 15061(b)(3), staff has
determined that the sale of the property will not have a significant adverse impact on the
environment. The attached resolution approves of this exemption finding.
CONFLICT OF INTEREST — (Gift Disclosure Requirements)
Richard C. Direct staff to terminate negotiations with Avista Development and re -list the
Tiger Rescue property with Rick John of Collins Commercial; and
2. Adopt the attached resolution finding that the public interest and
convenience require the sale of the property and announcing the City's intent to hold a
hearing to consider any protests
Prepared by: Marco A.
