Item #3 1 2 ORDINANCE NO. 0-05-04 3 AN ORDINANCE OF THE OF THE CITY COUNCIL OF THE CITY 4 OF COLTON AMENDING PORTIONS OF THE RECHE CANYON SPECIFIC PLAN AND AMENDING THE RECHE CANYON 5 SPECIFIC PLAN LAND USE MAP SHOWN AS AN ADDENDUM TO TITLE 18 OF THE COLTON MUNICIPAL CODE: FILE INDEX 6 NUMBER DT-65-01 7 WHEREAS, Ralph Herzig filed an application in July of 2001, File No. DT-65-01 8 (formerly DTV-65-01), for amendments to the Reche Canyon Specific Plan to accommodate 9 Tentative Tract Map No. 16249 to create a 47-lot subdivision with 2 open space lots ("Application") 10 on a 40+- acre site located at the easterly terminus of Shadid Drive, east of Reche Canyon Road 11 (Assessor Parcel No. 0282-211-01 and more particularly described in Exhibit "A" ("Subject Site"); 12 WHEREAS, the property affected by the Application is contained within the Reche 13 Canyon Specific Plan; 14 WHEREAS, the Application was reviewed, studied, and found to comply with the 15 California Environmental Quality Act ("CEQA") as more fully described below; 16 WHEREAS, on November 27, 2001, December 10, 2002, January 14, 2003, October 17 28, 2003 (Workshop), January 6, 2004 (Field Trip) and January 27, 2004, the Planning Commission 18 of the City of Colton ("Planning Commission") conducted duly noticed public hearings on the 19 Application at which time all persons wishing to testify in connection with the Application were heard 20 and the Application was comprehensively reviewed; and 21 WHEREAS, on February 17, 2004, the City Council of the City of Colton ("City 22 Council") conducted a duly noticed public hearing on the Application at which time all persons 23 wishing to testify in connection with the Application were heard, the Planning Commission's 24 25 recommendation was considered and the Application was comprehensively reviewed; and 26 WHEREAS, all other legal prerequisites to the adoption of this Ordinance have 27 occurred. 28 THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: SECTION 1.
