The City Council of the City of <br />Colton hereby finds and determines: <br />A. Based on the entire record before the City Council and all written and <br />oral evidence presented, the City Council finds that the proposed Text Amendments to the <br />Colton Municipal Code are consistent with the General Plan of the City of Colton because they <br />provide additional residential property rights relating to the keeping of animals and provide <br />more parking flexibility and opportunities for expansion of existing and proposed eating and <br />drinking establishments. These Text Amendments promote and achieve the City's General <br />Plan goals and policies relating to stable estate residential development and <br />commercial/industrial development opportunities. <br />B. Based on the entire record before the City Council and all written and <br />oral evidence presented, the City Council finds the Text Amendments are reasonably related <br />to the public welfare of the citizens of the City of Colton and the surrounding region because <br />they promote additional property rights and provide more parking flexibility to eating and <br />drinking establishments. <br />SECTION 2: Sections 18.20.120(A)(3), 18.22.120(A)(4), 18.24.120(A)(5), <br />18.26.120(A)(6), and 18.28.120(A)(6) of the Colton Municipal Code are hereby amended to <br />read as follows: <br />"For eating and drinking establishments, including fast food and drive-through <br />establishments, one space shall be provided for every one hundred square feet of gross floor <br />area, with a minimum of five spaces provided for each establishment." <br />SECTION 3: Section 18.54.020(A)(1) of the Colton Municipal Code is hereby <br />amended to read as follows: <br />"In an R -E, M-1 or M-2 zone to keep a total combination thereof of three or less <br />animals per acre, and providing all of them are kept at least sixty feet from any surrounding <br />residence and forty feet from any residence of the property in which they are kept." <br />SECTION 4: CEQA Determination. Based on the entire record before and all written <br />and oral evidence presented, the City Council finds the proposed Text Amendments are <br />exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to <br />Section 15061(b)(3)) of the CEQA Guidelines. Staff is directed to file a Notice of Exemption <br />with the San Bernardino County Clerk's Office within five (5) working days of the approval of <br />these Text Amendments. <br />SECTION 5. The documents and materials that constitute the record of proceedings <br />on which these findings and proceedings are based are located at 659 North La Cadena Drive, <br />Colton, California 92324.
